What Is Mediation?
Mediation provides an alternative means of dispute settlement to lengthy litigation proceedings. Participation in mediation must be entered into voluntarily by both or all parties involved and is generally conducted in a neutral, nonthreatening environment where each party is able to effectively negotiate and reach a mutually satisfactory agreement. Mediation sessions are facilitated by a trained and Qualified Custody and Visitation Family Law Mediator, listed on the Custody and Visitation Mediators Registry with the Louisiana State Bar, who allows each party to address his or her concerns and reach an effective agreement.

A trained, qualified mediator from SMS will sit down with you and the opposing party to go over each of the issues that must be considered in your family law dispute. When areas of dispute arise, she will remain focused on negotiating worthwhile settlements so that each party comes out of the situation with a confident outlook on the future.

Mediation sessions are $350.00 per hour, with a two-hour minimum. When a Mediation session is scheduled, the parties will be provided with an introductory packet, as well as an Agreement to Mediate, which must be signed by both parties prior to the first Mediation Session. You will be instructed as to what documents to bring with you, depending on what issues you and your former partner wish to Mediate.
After a successful Mediation, the Mediator will draft a Memorandum of Understanding for all to sign (Mediator, and all parties), which outlines the agreements which were made in the Mediation. The Memorandum of Understanding is used by an Attorney for either party to draft a document to be filed with the Court, which makes the agreements a Judgment of the Court, and legally-binding. Please note, if no attorney is involved, and if both parties request it, Virginia Erwin Sirera can prepare all legal documentation needed for set fees.
